교육은 한 국가의 “가장 중요한 공익”에 속하며 교육적 목적의 저작물 이용은 중요한 공적 기능의 수행이다. 최근 디지털화, 네트워크화로 인해 학교교육에서 교육 자료를 교환하는 수단이 확보되면서 저작물에 대한 이용 가능성이 비약적으로 증가하였다. 일반적으로 교육 목적의 저작물 이용은 대부분 저작권 침해의 예외로 규정하고 있는데, 그 규제 방식이나 범위는 국가마다 다르다. 우리나라는 〈저작권법〉에 예외규정을 두고 규제해왔지만, 최근 공정이용의 도입으로 교육 목적의 저작물 이용에 관한 입법 적용의 변화가 예상된다. 국내 〈저작권법〉의 공정이용 도입 역사가 짧고 관련 판례가 부재하므로, 본 연구에서는 미국 판례를 대상으로 교육 목적의 저작물 이용의 공정이용 판단요소를 살펴보았다. 공정이용 조항이 〈저작권법〉에 명시된 1976년 이전과 이후, 그리고 디지털 환경에서의 판결로 시기를 구분하여 판결논리를 분석하였는데, 분석 결과를 토대로 국내에서 추후 교육 목적의 저작물 이용에 관한 법원 판결에서 고려되어야 할 판단요소와 교육현장에서 저작물을 합법적으로 사용할 수 있는 정책적 개선방안을 제시하였다.

Education is “the most important public interest”, so the educational use of copyrighted works is performing such a public function. Recent networking and digitalization in our society enhanced availability of copyrighted works in the educational context. In a general sense, educational uses of copyrighted works are allowed as an affirmative defense to claims of infringement. The Copyright Law in Korea has educational use exceptions on the basis of the provisions concerning the limitation of economic right, too. However the change of legislative application is expected with the introduction of fair use doctrine in the Law. Because the history of fair use doctrine in Copyright Law is short and court decision concerning the educational fair use of copyrighted works is absent in Korea, this study examined court decisions standards of cases in the United States before and after 1976 when fair use clause was introduced in Copyright Act, and in the digital age. Based on the results of case study, this study provided the decision standards for the future judicial decisions in Korea and the improvement plans for the copyright policy on educational fair use.
